Terms of Service
Azimyx is a product of Webtech Holdings, LLC, a Florida limited liability company. These Terms of Service (the "Terms") govern access to and use of the Azimyx operational dashboard platform (the "Service"), provided by Webtech Holdings, LLC to authorized users of contracted businesses. By accessing the Service, you agree to be bound by these Terms.
1. Eligibility and Access
The Service is a private, business-to-business application made available exclusively to designated users of organizations that have entered into a separate service agreement with Azimyx. The Service is not offered to the general public. Access requires authentication credentials issued by Azimyx or the user's organization.
2. Permitted Use
You may use the Service solely for internal business purposes of the organization that authorized your access. You may not:
- Share, transfer, or resell access credentials;
- Reverse engineer, decompile, or attempt to extract source code;
- Use the Service to violate any applicable law or regulation;
- Circumvent security or rate-limiting controls.
3. Customer Data
The Service may display data sourced from third-party systems including ServiceTitan, QuickBooks Online, and similar business platforms, accessed under authorization granted by the customer organization. Azimyx acts as a data processor on behalf of the customer with respect to that data. All such data remains the property of the originating customer.
4. Text Message Program
The Service includes an employee recognition feature through which a customer organization may notify one of its employees by text message. Azimyx transmits these messages on the customer's behalf. Consent to business contact at the telephone number held in payroll records is obtained by the customer organization from its own employees under that organization's employment policies.
- Program: Azimyx Virtual High Five — employee recognition notifications.
- Content: a short notification naming the sender and linking to the recognition message. No marketing content is sent.
- Frequency: message frequency varies; messages are sent only when a colleague recognizes you, typically up to 5 messages per month.
- Cost: Azimyx does not charge for these messages. Message and data rates may apply from your mobile carrier.
- Opt out: reply STOP to any message to stop all further messages. Reply START to resume, or HELP for assistance.
- Carriers: supported on major United States carriers. Carriers are not liable for delayed or undelivered messages.
Opting out has no effect on employment and does not prevent recognition messages from being delivered by email. Employment matters are between the recipient and their employer; Azimyx operates the platform and does not employ message recipients. Recognition messages may include a written note, performance figures, and a video recorded by the sender; anyone holding the link may view the message, and links may be revoked on request.
5. Service Availability
The Service is provided on an "as is" and "as available" basis. Azimyx does not guarantee uninterrupted availability and may modify, suspend, or discontinue any portion of the Service at any time, with or without notice.
6. Limitation of Liability
To the maximum extent permitted by law, Azimyx shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to use of the Service, including but not limited to lost profits, data loss, or business interruption. Total liability for any claim arising under these Terms shall not exceed the fees paid by the customer organization in the twelve months preceding the claim.
7. Confidentiality
Users may have access to confidential financial and operational data of their organization. Such data must be treated as confidential and not disclosed outside the organization without authorization.
8. Termination
Azimyx may suspend or terminate access at any time for breach of these Terms or at the request of the customer organization. Upon termination, all rights granted hereunder cease immediately.
9. Changes to Terms
Azimyx may update these Terms from time to time. Material changes will be communicated to the customer organization. Continued use of the Service after such changes constitutes acceptance.
10. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. Any dispute shall be resolved in the state or federal courts located in Orange County, Florida.
